Captain’s Statement
I, Captain Adria Gutierrez, certify that I hold a valid U.S. Coast Guard Captain’s License and am legally qualified to take passengers on offshore fishing charters and boat tours. I promise to avoid unnecessary risks, monitor weather conditions, and operate the vessel safely and responsibly. My goal is to make your trip both memorable and safe.
Assumption of Risk
We, the undersigned, understand that we are boarding a charter fishing vessel to fish in open water or to take a boat tour underway in the Intracoastal Waterway (ICW).
We fully understand and assume all risks and hazards associated with offshore fishing and boat tours. These risks include, but are not limited to:
Sun, rain, lightning, sea spray, and other weather conditions
Seasickness
Pitching and rolling of the vessel
Slippery or wet decks
Injuries while boarding or disembarking
Fish, fishing activity, hooks, tackle, and gear
The unintentional conduct of other passengers on board
We understand and agree that we will not hold the Captain, crew, or company liable for any risks or hazards associated with offshore fishing or boat tours, and we expressly release them from all such risks and hazards.
Health Conditions
We further understand that this trip is not recommended for individuals with:
Circulatory problems
High blood pressure
Heart conditions
Pregnancy
Weak bones
Knee, back, or ankle issues
Any other pre-existing conditions that may be aggravated by motion, weather, or fishing activity
Waiver & Release Acknowledgment
By signing below, we acknowledge that:
We have read and understand this Promises, General Release, Waiver, and Consent Agreement.
We understand it is a legal document intended to inform us of risks and release the Captain, crew, and company from any and all liability for injuries, mishaps, or conduct of other passengers (intentional or unintentional), as well as crew (unintentional), during this fishing charter or boat tour.
Our signatures constitute a waiver and release for all future charters with Angling with Adria Charters, LLC.
